The NCRPO Regional Special Operations Unit (RSOU) with PNP Anti-Cyber Crime Group in coordination with the Pasig City Police Station, successfully implemented a Warrant to Search, Seize, and Examine Computer Data (WSSECD) at the premises being occupied by Fuwei Lending Corporation at about 2:20pm of September 26, 2019 located at Unit 2204–2205, Raffles Tower, Garnet St. Emerald Ave. Ortigas Center, Pasig City which resulted in the arrest of (5) five Chinese nationals; (49) Filipino employees and confiscation of gadgets and electronic devices used in illegal business.
The Warrant to Search, Seize, and Examine Computer Data (WSSECD) No. 2019-134-PSG was issued by Hon. Achilles A. A.C Bulauitan, Presiding Judge of RTC Branch 154, NCJR, Pasig City dated September 24, 2019.
The police operation stemmed from numerous charges filed by the complainants against Fuwei Lending Corporation, a SEC registered company, owner of the android application, Mango Loan. Mango Loan is a mobile software application that specialized in loan services both on Google Playstore and Apple Appstore. It provides financial services to customer who seeks to obtain loans.
Acting on the said complaint, operatives conducted series of validation through surveillance operation and eventually applied for the issuance of a Warrant to Search, Seize, and Examine Computer Data (WSSECD) which was favorably approved by the Honorable Court, hence, the operation was hatched.
Upon implementation of WSSECD No. 2019-134- PSG, operatives confiscated the following:
a. Eighty Seven (87) Computer System;
b. Four (4) Pieces of laptop computers;
c. Four (4) Pieces of Switch Hub;
d. Five (5) Pieces of router/modem;
e. Forty Seven (47) pieces of assorted cellular phones;
f. One (1) piece of Barangay Business Clearance plate;
g. One (1) piece of Business Plate from BPLO Pasig City;
h. Mayor’s Business Permit;
i. Barangay Business Permit;
j. Environmental Permit;
k. Security and Exchange Commission Permit;
l. Bureau of Internal Revenue Registration;
m. Unified Registration Record; and
n. Cash amounting to One Hundred Thousand Pesos (Php 100,000.00) in One Thousand peso (Php1,000.00) denomination.
During the actual operation, complainants showed up at unit 2204 Raffles Tower. They revealed that they created a group chat for the lending company victims where there are more or less 1,000 members. They also revealed that (5) five among their members committed suicide due to depression, embarrassment and emotional trauma caused by the lending company.
Investigation revealed that whenever the clients would download Mango Loan and has been approved to borrow, it will automatically withhold an on the spot interest which was payable within a short period of time. Mango Loan application is able to locate and access saved contacts and numbers as soon as it is installed and downloaded in the mobile phone.
Once the mobile application accessed the contacts, it will be used by the employees to call the debtors contact list to disclose the unpaid balances purposely to threaten, humiliate, coerce and intimidate the clients. These employees were trained to harass clients/debtor who fails to pay the loan they have availed.
Criminal complaints for violation of Section 33 of Republic Act 10173 (Data Privacy Act of 2012) in relation to Section 6 of Republic Act 10175 (Cyber Crime Prevention Act of 2012) is being prepared for inquest proceedings before the Pasig City Prosecutor’s Office against the arrested suspects.
NCRPO Regional Director PMGEN GUILLERMO LORENZO T ELEAZAR expressed his disappointment on the issue. “Alam nyo naman ang trabaho nyo! Alam nyo ba na may lima ng nagpaka matay sa ginagawa ninyong pananakot at panggigipit sa mga kababayan natin?”
PMGEN ELEAZAR also said, “Ang gusto kasi nating mangyari dito ay matigil na ang ginagawa nilang panloloko at pananakot sa ating mga kababayan na nag reresulta ng kanilang kahihiyan at same time violation ng kanilang privacy in accordance with the law”.
